GENERAL BOOKING CONDITIONS OF
- IDENTIFICATION OF THE PARTIES.
On the one hand ‘YULY PAULIN TRUJILLO GONZALEZ’, hereinafter NEW HOME JÁVEA whose other identification details are: Yuly Paulin Trujillo Gonzalez, holder of DNI number 53948982-K, and domiciled at Avd. del Pla núm. 126 Oficina 2.05 in Javea (Alicante) and owner of the domain www.newhomejavea.com, hereinafter Website, and with company code authorised for holiday rentals in the Valencian Community CVEE00817-A, on the other hand; the User, the person who books the services offered through the Website. NEW HOME JÁVEA and the User may, depending on the context, be referred to as the parties. -
APPLICABLE LEGISLATION.
These General Booking Conditions (hereinafter GRC) are subject to Spanish law, to the provisions of Law 7/1998, of 13 April, on General Booking Conditions; in Royal Legislative Decree 1/2007, of 16 November, which approves the revised text of the General Law for the Defence of Consumers and Users and other complementary laws; in Royal Decree 1906/1999, of 17 December, which regulates the Telephone or Electronic Booking with General Conditions; Organic Law 3/2018, of 5 December, on the Protection of Personal Data and the guarantee of digital rights; Law 7/1996, of 15 January, on the Regulation of Retail Trade; and Law 34/2002, of 11 July, on Information Society Services and Electronic Commerce; Decree 10/2021, of 22 January, of the Consell, of approval of the Regulations governing tourist accommodation in the Comunitat Valenciana, modified by Royal Decree 9/2024, of 2 August, of the Consell, of modification of the regulations governing dwellings for tourist use.Those bookings whose duration is longer than 10 days will not be governed by the regulations governing tourist accommodation.

SCOPE OF APPLICATION, ACCEPTANCE AND MODIFICATION.
These CGR, govern the booking contracts between NEW HOME JÁVEA and the User made through the Website.The User, who declares that he/she has sufficient legal capacity* to contract, will be bound by the present GRC at the time he/she makes a reservation through the Website.
The GRC may be subject to unilateral modification by NEW HOME JÁVEA without notice, however, the User will be bound to those in force at the time of booking.
The GRC may be consulted, printed and stored by the User prior to the start of the booking procedure.
Any special conditions that may be applicable, or the modification of these GRC, must be formalised by means of a separate document, which must be signed by both parties in order to be effective.
*LEGAL LIMITATIONS: It is understood that the Lessee is not a minor under 18 years of age. Minors are technically restricted from registering on this website and therefore may not make purchases or reservations, in compliance with legal regulations. Data sent by minors will not be processed, as this is prohibited by law.

PAYMENT TERMS. PRE-CONTRACTUAL COMPLETION.
The advance payment to make the reservation is 30% depending on the type of property, this amount can be discounted from the final price of the accommodation, however, and in the event that the amount varies, the User will be previously informed through the Website.
The amount of the reservation will be paid, as selected:
• Payment by credit card: the payment will be made at the time of booking and the next paymentwill be informed in the confirmation email when to proceed.
• Payment by bank transfer: you will have to make the payment and send the receipt within a maximum period of 48 working hours from receipt of the email detailing the bank account to make the reservation, in case of failure to comply with this requirement the reservation will be automatically cancelled.
Once the payment has been verified, the reservation contract between the parties will be understood to be formalised. If the following payments are not made by the User within the deadlines established in the reservation document, the reservation will be considered cancelled and NEW HOME JÁVEA will not pay any amount whatsoever, and the amounts paid will be used as compensation for damages caused.
Both NEW HOME JÁVEA and the guest have 24 hours to cancel the reservation free of charge.
The payment of the remaining amount will be determined in the reservation document that will be sent by email when the reservation is made.
- PRICES AND APPLICABLE TAXES.
The prices published for the contracting of overnight stays include applicable taxes. NEW HOME JÁVEA is not responsible for any possible errors in the published prices, in which case, the User will be duly informed of this circumstance, and may choose to book them for the correct amount or cancel the aforementioned reservations without any cost or penalty.
NEW HOME JÁVEA reserves the right to modify the prices published on the Website when it deems appropriate. In any case, the above will not apply to those reservations made prior to the modification.
- FORMS OF PAYMENT.
The permitted forms of payment are:
• Credit card.
• Bank transfer to the bank account provided by NEW HOME JÁVEA.
- OBLIGATIONS OF THE PARTIES.
7.1. Obligations of NEW HOME JÁVEA:
• Provide services in accordance with the CGR and without breach of contractual good faith.
• To make available to the User the GRC and the particular conditions that, where appropriate, are applicable.
• To send the User a receipt or invoice for the bookings contracted.
• Proceed to register the accommodation.
7.2. Obligations of the User:
• Carry out full compliance with the provisions of the CGR and, where appropriate, of the particular conditions that may apply.
• Complete the registration forms with accurate and current information. The User shall be solely responsible for the accuracy and updating of the information. And specifically provide NEW HOME JÁVEA with the following details of all guests:
◊ First surname.
◊ Second surname.
◊ Identity card number.
◊ Document support number.
◊ Type of document.
◊ Telephone, mobile phone or e-mail.
◊ Relationship, if any traveller is a minor.
• Maintain the confidentiality of the information provided and immediately notify the loss, loss, theft, robbery, illegitimate access, as well as its knowledge by third parties.
• Respect the rules of the community of owners to which, where appropriate, the property may belong.
• Respect the number of occupants established in the reservation.
• To leave the property in the same state of conservation and cleanliness as at the time of entry.
• To act in a diligent manner, at all times conforming to the canons of good usage and contractual good faith throughout the life of the contractual relationship.
- SERVICES
The characteristics of the property, the services included in the price and some of the activities that can be carried out near the property will be detailed in the property file.
- DEPOSIT
A deposit will be charged to a bank card as a security deposit, which will be detailed in each property.
The security deposit is used as a guarantee of the good use, conservation of the furniture, equipment and conditions of use of the contracted accommodation. If there are no deficiencies, the deposit will be returned in full within a maximum period of 15 days after departure, after general cleaning and checking of the accommodation. The user must leave the accommodation in the same state in which it was found, tidy and without accumulated rubbish, otherwise a supplement will be requested or, in serious cases, the deposit will be forfeited.
10. KEY COLLECTION
NEW HOME JÁVEA will collect the keys according to the instructions given by NEW HOME JÁVEA. The day before arrival, the user must contact NEW HOME JÁVEA to organise the collection of the keys.
The keys will be handed over at the meeting point agreed between the parties.
The timetable for key collection will be between 16:00 and 21:00 on the day of arrival. If you arrive outside these hours or on a public holiday, you must contact NEW HOME JÁVEA in your booking email to coordinate the delivery of keys.
11. FAILURES.
NEW HOME JÁVEA, will check the property before handing over the keys, making sure that all electrical appliances are in perfect working order, as well as the water, electricity, gas and other services in the property.
In the event that any electrical appliance should stop working or there should be any fault in the water, electricity, gas or other services, the User must notify NEW HOME JÁVEA so that they can notify the corresponding authorised technical service to repair the fault as soon as possible.
12. DESCRIPTIONS, PHOTOS AND EXTERNAL SERVICES DISPLAYED.
We strive to provide you with quality information. The photos and descriptions entered are reviewed periodically. However, there may be differences in the furnishings or interiors displayed. Furthermore, certain services such as swimming pools, sports facilities, as well as the information on external services detailed on the website may be temporarily out of service due to seasonal or repair work. These changes will not entitle you to any compensation or claim.
13. CANCELLATION POLICY.
NEW HOME JÁVEA, reserves the right of cancellation in the event of not receiving the payment specified in the reservation document according to the established deadlines. In the event of a serious incident in the property that makes it impossible to rent it, NEW HOME JÁVEA will return the amounts paid in advance, without the right of the User to make any claim whatsoever.
The cancellation and modification by the User must be communicated as soon as possible to the email address indicated on the booking voucher.
In the event of cancellation by the User, no refund of any amount paid will be made.
The amount of the penalty will be used to cover expenses incurred, damages suffered and loss of profits.

14. PROHIBITIONS
It is expressly forbidden: the use of the dwelling as a business premises, warehouse or office or for the filming of films, advertising spots, reports or any other type of unauthorised filming; the carrying out of building work; the possession of inflammable, explosive or unhygienic materials; the sub-letting, transfer or assignment of the dwelling, whether in whole or in part, free of charge or onerously; the placing of windows and windowsills on the façade of the dwelling; the subletting, transfer or assignment of the dwelling, whether in whole or in part, free of charge or for a fee; the placing on the façade of windows and balconies, of advertisements, signs and other elements that alter or modify the uniformity or aesthetics of the dwelling, and the installation of motors and/or machines.
Reservations are restricted to groups of young people.
Pets are not allowed in some of the properties and will be detailed in the property description.
Large celebrations are not allowed. Only visits from friends and family are allowed. It is not allowed to stay overnight in the property more people than those indicated in the booking document.
Smoking and lighting candles inside the property is forbidden.
15. DEPARTURE AND KEY HANDOVER.
Departure must take place before 10:00 am. The User must inform NEW HOME JÁVEA at the time of receiving the keys of the approximate time of departure. In the event that he/she wishes to leave earlier than the time or day foreseen in this contract, he/she must notify NEW HOME JÁVEA. In the event that you wish to leave later for various reasons, you must ask NEW HOME JÁVEA and we will study the possibility of extending your stay for a few hours at an additional cost.
At the end of the period of stay, the User must vacate the property and return the keys the same day, leaving the property at the free disposal of NEW HOME JÁVEA. Failure to do so NEW HOME JÁVEA will retain the deposit and the User must pay, apart from the costs and expenses caused by the breach and as a penalty clause, an amount equal to three times the daily rent, payable by days due until the free disposal of the property by NEW HOME JÁVEA, without prejudice to the costs, expenses and other compensation that were at its expense including minutes of lawyers and solicitor, although their intervention was not required.
